OVERVIEW

Welcome to Pureflect. The terms “we,” “us,” and “our” refer to Pureflect. Pureflect operates this website and online store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase products from Pureflect.

By accessing or using the Services, or by placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your state or jurisdiction of residence to place an order. If you allow a minor to access the Services through a device or account you control, you are responsible for their activity.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or communicating with us. You are responsible for protecting your account credentials and for activity conducted through your account.

You may not transfer, sell, assign, or license your customer account to another person.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, specifications, images, colors, dimensions, and other information accurately. However, colors and appearance can vary depending on your device, screen settings, lighting, and manufacturing variations.

Measurements and product dimensions may be approximate unless expressly stated otherwise. You are responsible for reviewing the product description, compatibility information, warnings, and instructions before purchasing or using a product.

We may update product information, discontinue products, or limit quantities or availability at any time. Any material change affecting an order already accepted will be handled in accordance with these Terms and applicable law.

SECTION 3 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase. An order acknowledgment does not necessarily mean that we have accepted the order. Acceptance occurs when we send a shipping confirmation or otherwise expressly confirm that the order has been accepted.

Orders are subject to payment authorization, address verification, product availability, fraud screening, and compliance with these Terms. If we decline or cancel an order after payment has been collected, we will issue a refund to the original payment method.

Please review your order carefully before submitting it. If you need to cancel or modify an order, contact us as soon as possible. We will make a reasonable effort to assist, but changes or cancellations cannot be guaranteed after fulfillment has begun.

We may limit or cancel quantities that reasonably appear to have been purchased for unauthorized resale, fraudulent activity, abuse, or another prohibited purpose.

SECTION 4 — PRICES, TAXES, AND PAYMENT

Unless expressly stated otherwise, prices are displayed in United States dollars (USD). Prices, discounts, and promotions may change without notice, but any change will not affect an order already accepted except in the case of an obvious pricing or listing error.

Applicable taxes, shipping charges, and other charges will be displayed before you complete checkout when required. You will not be charged undisclosed fees by Pureflect after placing your order.

If a product is listed at an obviously incorrect price or contains a material error, we may contact you for instructions or cancel the affected order and issue a full refund.

You represent that you are authorized to use the payment method submitted with your order. You agree to provide accurate and complete billing, payment, and contact information.

Promotions may be subject to additional terms. If promotional terms conflict with these Terms, the promotional terms will govern solely with respect to that promotion.

SECTION 5 — SHIPPING AND DELIVERY

We currently ship to eligible addresses within the United States. Additional conditions, estimated processing times, delivery estimates, and available shipping options are described in our Shipping Policy and on applicable product or checkout pages.

Delivery dates are estimates unless expressly identified as guaranteed. Some products may be fulfilled by third-party suppliers, warehouses, or logistics providers. Regardless of the fulfillment method, your purchase is made from Pureflect and questions about your order should be directed to us.

If we cannot ship an order within the timeframe communicated at the time of purchase, we will notify you and provide the option to accept the delay or cancel the affected order for a full refund.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you discover an address error. Address changes cannot be guaranteed after fulfillment has begun.

Risk of loss passes to you when the order is delivered to the shipping address provided at checkout, subject to applicable law. If tracking shows delivery but you cannot locate the package, contact us promptly so we can review the available information with the carrier or fulfillment provider.

SECTION 6 — RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, damaged items, incorrect items, and order cancellations are governed by our Return & Refund Policy, which forms part of these Terms.

If there is a conflict between this section and the Return & Refund Policy regarding a return or refund, the Return & Refund Policy will govern.

SECTION 7 — PRODUCT USE AND SAFETY

You agree to use products only for their intended purpose and in accordance with all instructions, warnings, age recommendations, care information, and safety guidance supplied with the product or displayed on the product page.

Pet products should be selected with consideration for the animal’s size, age, health, behavior, and individual needs. Supervise pets when appropriate and discontinue use if a product becomes damaged or presents a potential hazard.

Information provided through the Services is for general informational purposes and is not veterinary, medical, or other professional advice. Consult an appropriately qualified professional when you have questions about an animal’s health, nutrition, treatment, or safety.

SECTION 8 — INTELLECTUAL PROPERTY

The Services and their content—including text, graphics, photographs, videos, logos, designs, icons, product reviews, arrangement, and presentation—are owned by or licensed to Pureflect or their respective owners and are protected by applicable intellectual property laws.

You may use the Services only for lawful, personal, and noncommercial purposes. You may not reproduce, distribute, modify, publish, display, sell, license, scrape, or commercially exploit any portion of the Services without prior written permission from the applicable rights holder.

Pureflect’s name, logo, designs, and other brand identifiers are trademarks or other proprietary identifiers of Pureflect or its licensors, whether registered or unregistered. Other names and marks belong to their respective owners.

SECTION 9 — THIRD-PARTY TOOLS, SERVICES, AND LINKS

The Services may include tools, applications, payment services, tracking services, links, or functionality provided by third parties. These third-party services may be governed by their own terms and privacy policies.

We do not control independent third-party websites or services and are not responsible for their content, availability, or practices. If you leave our website or purchase directly from an independent third party, you do so subject to that third party’s terms.

This section does not limit Pureflect’s responsibilities for products purchased directly from Pureflect.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Pureflect is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are transactions directly between you and Pureflect.

Shopify is not the seller of the products offered by Pureflect and is not responsible for the fulfillment, quality, safety, legality, or performance of those products. To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from transactions between you and Pureflect.

SECTION 11 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain personal information may also be processed by Shopify in accordance with Shopify’s Privacy Policy.

Information may be shared with service providers, payment processors, fulfillment partners, analytics providers, and other parties as described in our Privacy Policy and as necessary to operate the Services.

SECTION 12 — FEEDBACK AND REVIEWS

If you submit a review, suggestion, photograph, video, comment, or other content (“Feedback”), you grant Pureflect a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and promote that Feedback in connection with the Services and Pureflect’s business.

You represent that you own or have permission to submit the Feedback and that it does not violate another person’s intellectual property, privacy, publicity, or other rights. You must disclose any compensation or incentive received in connection with a review when required by law.

We may moderate or remove Feedback that we reasonably believe is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inconsistent with these Terms.

SECTION 13 — ERRORS, AVAILABILITY, AND CORRECTIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability.

We may correct or update inaccurate information. If a material error affects an order you have already placed, we will notify you and, when appropriate, offer the option to proceed with the corrected information or cancel the affected order for a refund.

SECTION 14 — PROHIBITED USES

You may use the Services only for lawful purposes. You may not:

• Violate any applicable law, regulation, or third-party right.
• Submit false, fraudulent, misleading, or unauthorized information.
• Interfere with the security, availability, or operation of the Services.
• Introduce malware, viruses, harmful code, or disruptive technology.
• Impersonate another person or misrepresent your identity or authority.
• Collect personal information about others without authorization.
• Use the Services to send spam, phishing messages, or unauthorized advertising.
• Scrape, copy, reproduce, resell, or exploit the Services or their content without authorization.
• Circumvent access controls, fraud screening, rate limits, CAPTCHAs, or other protective measures.

We may restrict or terminate access when we reasonably believe these Terms have been violated or the Services are being used unlawfully or fraudulently.

SECTION 15 — SUSPENSION AND TERMINATION

We may suspend or terminate your access to the Services if you materially violate these Terms, engage in fraudulent or unlawful conduct, threaten the security of the Services, or misuse our systems.

Termination does not eliminate payment obligations or other liabilities incurred before termination. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will remain effective.

SECTION 16 — WARRANTIES AND DISCLAIMERS

We make reasonable efforts to keep the Services available and the information accurate, but we do not guarantee that access will always be uninterrupted, secure, or error-free.

Except for any express warranty stated on a product page or provided by the product’s manufacturer, and to the fullest extent permitted by applicable law, the Services are provided on an “as available” basis without additional express warranties from Pureflect.

Products may be covered by manufacturer warranties when expressly stated. Nothing in these Terms excludes or limits any warranty, remedy, or consumer right that cannot legally be excluded or limited.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pureflect and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost savings, or loss of data, arising from or related to the Services or a product purchased through them.

To the fullest extent permitted by applicable law, Pureflect’s total liability for a claim relating to a particular product or order will not exceed the amount you paid to Pureflect for that product or order.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury, or another liability that cannot legally be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

SECTION 18 — INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold Pureflect harmless from third-party claims, losses, and reasonable expenses arising from your unlawful misuse of the Services, your material breach of these Terms, or your violation of another party’s rights.

This obligation does not apply to claims caused by Pureflect’s own negligence, misconduct, or breach of these Terms.

SECTION 19 — EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for a failure or delay caused by events outside our reasonable control, including natural disasters, severe weather, labor disruptions, carrier interruptions, government actions, public health emergencies, network failures, or disruptions affecting suppliers or logistics providers.

This section does not limit your right to receive notice, cancel a delayed order, or obtain a refund when required under our policies or applicable law.

SECTION 20 — SEVERABILITY, WAIVER, ENTIRE AGREEMENT, AND ASSIGNMENT

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the entire agreement between you and Pureflect concerning the Services and supersede prior communications concerning the same subject matter.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, transfer of the business, or operation through a successor entity, subject to applicable law.

SECTION 21 — GOVERNING LAW AND CONSUMER RIGHTS

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Any dispute that is not resolved informally may be submitted to a court of competent jurisdiction.

Nothing in these Terms limits any mandatory consumer protection rights or remedies available to you under the laws applicable in your place of residence.

SECTION 22 — CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page. We may update these Terms by posting a revised version and changing the “Last updated” date.

When required by applicable law, we will provide additional notice of material changes. Changes will apply prospectively from their effective date and will not retroactively alter an order already accepted unless required by law or agreed with you.
